Who is responsible to pay for installation of water meters and/or stop cocks? Is it the body corporate or the owner?

There are different ways of looking at it. I would say that the body corporate is responsible to install and maintain water meters as this will be on common property. The debate comes in if it services your unit alone, should it be for the body corporate or for the owner's account. I interpret the act that if it is on common property, the body corporate needs to attend to it.

Hi Tony, I refer to Prescribed Management Rule 33.3 which reads: Notwithstanding the provisions of subrules (1) and (2), the trustees shall, if so required in writing by a majority of owners, procure the installation and maintenance in good working order, at the body corporate's cost, of seperate meters to record the consumption of electricity, water and gas in respect of each individual section and the common property.

The trustees in my complex have decided that the building needs to be painted. A special levy has been raised and a huge percentage of owners cannot afford the extra levies. Can the trustees make that decision alone? What recourse do the owners have if the majorityis not in favour of the special levy.

Hi Tony, The trustees have a fiduciary responsibility to maintain the building. If the painting is necessary and the body corporate do not have the funds to pay for the maintenance, the trustees, via a trustees resolution (refer S37(2A)), may raise the funds for the painting. If the owners do not see the painting as abosultely necessary, I would suggest the calling of a Special General Meeting.
